This article aims to analyze the legal regulation of performers’ rights in Lithuania. Analysis is divided in two parts: the first part analyses performers’ economic rights by comparing them to the authors’ economic rights and the legal regulation of performers’ rights in foreign countries; the second part of article focuses on the different content of performers’ economic rights due to the mean of fixation of performance (unfixed performance, performance fixed to the phonogram, audiovisual fixation of performance). Analysis of the Lithuanian (...) legal regulation on performers’ economic right has shown that although Copyright Law of Lithuania in general complies with international and EU acts governing performers’ rights, four main fields of legal regulation need to be revised. Firstly, Copyright Law should provide that when concluding an agreement concerning an audiovisual fixation of his performance with a producer of audiovisual work the performer transfers his exclusive rights to the producer, the performer shall retain an unwaivable right to receive an equitable remuneration for every transferred exclusive right. Secondly, the legal definition of phonogram published for the commercial purposes should be provided in the Law on Copyright of Lithuania. (shrink)

Life in good health and health security prove the most significant values highlighted by moral philosophy in the time of the environmental crisis. The imperfect operation of healthcare poses a threat for humans. Administrative measures regulate insufficiently medicine and healthcare. They need to be backed up by ethics, which cannot be seen solely as ethics of an individual’s conscience. What is needed is professional, practice-oriented and institutionalized-within-healthcare-organizations ethics. Recently, there have appeared a great number of new international documents setting standards (...) of medical procedures in compliance with the requirements of the new bioethical values. At the same time elements of the ethical infrastructure such as bioethics commissions or committees have been created. In the face of the specificity and the complexity of ethical issues and problems encountered within contemporary medical practice the requirement of high ethical competence of all healthcare workers often fails to be sufficient. This book contributes to the analysis of film from a multimodal and textual perspective by extending formal semantics into the realm of multimodal discourse analysis. It accounts for both the inferential as well as intersemiotic meaning making processes in filmic discourse and therefore addresses one of the main questions that have been asked within film theory and multimodal analysis: How do we understand film and multimodal texts? The book offers an analytical answer to this question by providing a systematic tool (...) for the description of this comprehension process. It aims to advance knowledge of the various resources in filmic texts, the ways the resources work together in constructing meaning and the ways people understand this meaning construction. Recent discussions on corporate citizenship highlight the new political role of corporations in society by arguing that corporations increasingly act as quasi-governmental actors and take on what hitherto had originally been governmental tasks. By examining political and sociological citizenship theories, the authors show that such a corporate engagement can be explained by a changing conception of corporate citizens from corporate bourgeois to corporate citoyen. As an intermediate actor in society, the corporate citoyen assumes co-responsibilities for social and civic affairs and (...) actively collaborates with fellow citizens beyond governmental regulation. This change raises the question of how such corporate civic engagement can be aligned with public policy regulations and how corporate activities can be integrated into the democratic regime. To clarify the mode of CC contributions to society, the authors will apply the tenet of subsidiarity as a governing principle which allows for specifying corporations’ tasks as intermediate actors in society. By referring to the renewed European Union strategy for Corporate Social Responsibility, the authors show how such a subsidiary corporate-governmental task-sharing can be organized. (shrink)

In response to stakeholder pressure, companies increasingly make ambitious forward-looking sustainability commitments. They then draw on corporate policies with varying degrees of alignment to disseminate and enforce corresponding behavioral rules among their suppliers and business partners. This goal-based turn in private sustainability governance has important implications for its likely environmental and social outcomes. Drawing on paradox theory, this article uses a case study of zero-deforestation commitments in the Indonesian palm oil sector to argue that goal-based private sustainability governance’s characteristics set (...) the stage for two types of paradoxes to emerge: performing paradoxes between environmental, social, and economic sustainability goals, and organizing paradoxes between cooperation and competition approaches. Companies’ responses to these paradoxes, in turn, can explain the lack of full goal attainment and differential rates of progress between actors. These results draw our attention to the complexities hidden behind governance through goal setting in the corporate space, and raise important questions about the viability of similar strategies such as science-based targets and net-zero goals. This article suggests that the best available normative framework for guiding conduct in war rests on categories that do not echo the terms of an individual rights-based morality, but acknowledge the impossibility of rendering warfare fully morally justified. Avoiding the undue moralization of conduct in war is an imperative for a normative framework that strives to actually give behavioral guidance to combatants, most of whom will inevitably be ignorant of the moral status of the individuals they encounter on the battlefield (...) and will often be uncertain or mistaken about the justice of their own cause. We identify the requirement of military necessity, applied on the basis of what we refer to as the “St. Petersburg assumption”, as the main principle according to which a combatant should act, regardless of which side or in which battlefield encounter she finds herself. This pragmatic normative framework enjoys moral traction for three reasons: first, in the circumstances of war it protects human life to a certain extent; second, it makes no false claims about the moral justification of individual conduct in combat operations; and, third, it fulfills morally important functions of law. However, the criterion of military necessity interpreted on the basis of the St. Petersburg assumption does not directly replicate fundamental moral prescriptions about the preservation of individual rights. The article analyses the theoretical aspects of profit and profitability assessmentWhile assessing company’s activity efficiency in various aspects, its competitiveness and growth possibilities, it is not enough to analyse absolute profit indices and based on them to take particular decisions, because an absolute profit index does not reflect company’s real financial situation. More comprehensive information is obtained by calculating relative profitability indices and comparing them with profitability. Besides, profitability indices in a structured form provide to company’s managers the most important and most precise information in form of indicators based on which there is a possibility to assess company’s financial situation and to forecast company’s future financial situation, foresee activity’s success and failures. Therefore, even a profitable company needs a constant analysis of these indices, their dynamics, affecting factors, because due to affecting factors the company’s managers can assess and forecast profitability indices. In search for the ways how to increase a profit and profitability indices, it is very relevant for the company’s managers to assess introduction of new services to a market, because new implemented services reach a success, the company’s managers can take decisions, determining dynamics of development of profitability indices, and direct company’s management towards profitable direction.The article analyses the theoretical aspects of profit and profitability assessment. Arūnas Sverdiolas’s way of reading Deleuze raises questions about the compatibility of two traditions: how and to what extent can a philosopher of Culture understand a philosopher of Nature and Life? Deleuze, formed in the rationalist tradition, resists the philosophy of Consciousness and Meaning, in which universality is held higher than empirical particularity. thinking – a cause of allergy for a Frenchman – is on the contrary an aspiration for a Lithuanian. Sverdiolas’s formation has its roots in resistance against Marxist-materialist (...) thinking, with the help of philosophy of culture. He considers the whole philosophy of the 20th century as an anthropological philosophy of Culture. This does not facilitate understanding Deleuze’s thought. His vitalist philosophy is deemed paramaterialist and considered to be reductionist. Hence a contradiction: Deleuze is recognized as a gifted historian of philosophy, but his own thinking is viewed with scepticism, without seeing its roots in the history of philosophy. The reason why Deleuze’s philosophy rejects the anthropocentric perspective – that of the ego and of consciousness – is not considered. (shrink)

Fidelity as a moral value which may qualify persons or determinate modes of behaviour is discussed. Some examples of fidelity are given to show that fidelity may have various forms depending on whom or what it concerns and how deeply one is engaged. Fidelity is determined as a personal value consisting in a persistent approval of some chosen ensembles of values, in connection with the willingness to serve them in the way required by them in various situations. If fidelity is (...) one of moral values there are applicable to it all the statements concerning moral values in general. The difference between fidelity and other moral values lies in the qualitative specificity which may be grasped intuitively. The realization of fidelity must be accomplished consciously and the corresponding acts must spring from the centre of our „ego”. The fidelity to the ensembles of values preferred to others should not violate the objective hierarchy of values, i.e., it should appear within orderly relations to the whole system of values. How do civilians react to being harmed in war? Existing studies argue that civilian casualties are strategically costly because civilian populations punish a belligerent who kills civilians and support the latter's opponent. Relying on eighty-seven semi-structured interviews with victims of coalition attacks in Afghanistan, this article shows that moral principles inform civilians’ attitudes toward their own harming. Their attitudes may therefore vary with the perceived circumstances of an attack. Civilians’ perception of harm as unintended and necessary, in accordance with the (...) moral principles of distinction and necessity, was associated with narratives that cast an attack as relatively more legitimate and with a partial or full release of the coalition from blame. The principle of proportionality, which requires that civilian casualties are caused in pursuit of a legitimate war aim, informed their abstract attitudes toward civilian casualties in Afghanistan. Two rules of international law, which accord with the moral principles of distinction and necessity, were reflected in the civilians’ attitudes. The legal rule of proportionality, which diverges from the namesake moral principle, failed to resonate with the civilians. The article explores whether compliance with the legal rules of distinction and necessity can contribute to mitigating the strategic costs of civilian casualties. (shrink)

The transcription factor NF‐κB (p65/p50) plays a central role in the coordination of cellular responses by activating the transcription of numerous target genes. The precise role of the dynamics of NF‐κB signalling in regulating gene expression is still an open question. Here, we show that besides external stimulation intracellular parameters can influence the dynamics of NF‐κB. By applying mathematical modelling and bifurcation analyses, we show that NF‐κB is capable of exhibiting different types of dynamics in response to the same stimulus. (...) We identified the total NF‐κB concentration and the IκBα transcription rate constant as two critical parameters that modulate the dynamics and the fold change of NF‐κB. Both parameters might vary as a result of cell‐to‐cell variability. The regulation of the IκBα transcription rate constant, e.g. by co‐factors, provides the possibility of regulating the NF‐κB dynamics by crosstalk. (shrink)

Robots as social companions in close proximity to humans have a strong potential of becoming more and more prevalent in the coming years, especially in the realms of elder day care, child rearing, and education. As human beings, we have the fascinating ability to emotionally bond with various counterparts, not exclusively with other human beings, but also with animals, plants, and sometimes even objects. Therefore, we need to answer the fundamental ethical questions that concern human-robot-interactions per se, and we need (...) to address how we conceive of »good lives«, as more and more of the aspects of our daily lives will be interwoven with social robots. This volume of essays studies the problem of transition in economics from a historical perspective. It uses historical ideas and theories in a modern context to examine economic thought. It aims to show that social and historical context are important when considering economic transitions.

Morphogenesis is one of the fundamental processes of developing life. Gastrulation, especially, marks a period of major translocations and bustling rearrangements of cells that give rise to the three germ layers. It was also one of the earliest fields in biology where cell movement and behaviour in living specimens were investigated. This article examines scientific attempts to understand gastrulation from the point of view of cells in motion. It argues that the study of morphogenesis in the twentieth century faced a (...) major dilemma, both epistemological and pictorial: representing form and understanding movement are mutually exclusive, as are understanding form and representing movement. The article follows various ways of modelling, imaging, and simulating gastrular processes, from the early twentieth century to present-day systems biology. The first section examines the tactile modelling of shape changes, the second cell cinematography, mainly the pioneering work of the German embryologists Friedrich Kopsch and Ernst Ludwig Gräper in the 1920s but also a series of classic, yet not widely known, studies of the 1960s. The third section deals with the changes that computer simulation and live-cell imaging introduced to the modelling of shape change and the study of cell movement at the turn of the twenty-first century. Although live-cell imaging promises to experiment upon and represent the living body simultaneously, I argue that the new visuals are an obstacle rather than a solution to the puzzle of understanding cell motion. This issue ofScience in Contextis dedicated to the question of whether there was a “cinematographic turn” in the sciences around the beginning of the twentieth century. In 1895, the Lumière brothers presented their projection apparatus to the Parisian public for the first time. In 1897, the Scottish medical doctor John McIntyre filmed the movement of a frog's leg; in Vienna, in 1898, Ludwig Braun made film recordings of the contractions of a living dog's heart (cf. Cartwright 1992); in 1904, Lucien (...) Bull filmed in slow motion a bullet entering a soap bubble. In 1907 and 1908, respectively, Max Seddig and Victor Henri recorded Brownian motion with the help of a cinematograph (Curtis 2005). In 1909, the Swiss Julius Ries was one of the first to film fertilization and cell division in sea urchins (Ries 1909). In that same year in Paris, Louise Chevroton and Frédéric Vlès used a film camera to observe cell division in the same object (Chevroton and Vlès 1909). As early as 1898, the Parisian surgeon Eugène-Louis Doyen began filming several of his operations, among them the spectacular separation of the Siamese twins Doodica and Radica (Bonah and Laukötter 2009). And in England, the scientist and zoologist Francis Martin Duncan produced an array of popular-scientific films for Charles Urban: “The unseen world: A series of microscopic studies” was presented to the public in the Alhambra Theatre in London for the first time in 1903 (see Gaycken in this issue). Artykuł nawiązuje do jednej z najbardziej intensywnych dyskusji we współczesnej filozofii języka, jaką jest spór o zasięg i charakter wpływu kontekstu wypowiedzi na znaczenie użytych w niej wyrażeń, gdzie kontekst jest rozumiany bardzo ogólnie, jako „zewnętrzne okoliczności, które wykorzystywane są przez uczestników sytuacji komunikacyjnej do określenia pewnej własności pewnej jednostki językowej”. Jest to w istocie spór o autonomię semantyki. Spornymi stanowiskami w toczonej debacie są kontekstualizm i minimalizm semantyczny. Zaproponowane ujęcie wypowiedzi jako celowego i racjonalnego aktu komunikacji, w którym wyrażenie (...) językowe i kontekst stanowią odrębne źródła informacji będącej przedmiotem interpretacji wypowiedzi, pozwoliło bardziej szczegółowo określić rolę kontekstu i znaczenia językowego w determinowaniu treści wypowiedzi. Z tej perspektywy została przeprowadzona analiza wypowiedzi zdania ‘Jan jest wysoki’ w trzech różnych kontekstach, co pozwoliło lepiej ocenić siłę argumentów badanych stanowisk. Rozważania zostały przeprowadzone jako próba obrony minimalizmu semantycznego, który utrzymuje, że grupa wyrażeń, których znaczenia zależą od kontekstu, ogranicza się do typowych wyrażeń okazjonalnych. Wpływ kontekstu na wyrażenia spoza tej grupy zaznacza się jedynie na płaszczyźnie pragmatycznej. Procesy pragmatyczne nie zmieniają znaczenia językowego wyrażeń użytych do sformułowania wypowiedzi, a jedynie wpływają na interpretację wypowiedzi. Zdania języka po usunięciu typowych wyrażeń okazjonalnych wyrażają sądy minimalne i nie wymagają dodatkowej informacji kontekstowej. Minimalizm semantyczny pozostaje w opozycji do stanowiska kontekstualizmu głoszącego, że niemal wszystkie wyrażenia języka naturalnego są wrażliwe na kontekst, który moduluje ich znaczenie na poziomie semantycznym. Zgodnie ze stanowiskiem kontekstualizmu zdania języka, takie jak np. ‘Jan jest wysoki’, nie mają określonych warunków prawdziwości, gdyż warunki prawdziwości można przypisać tylko konkretnym wypowiedziom, a nie zdaniom rozumianym jako wyrażenia językowe. Przeprowadzona analiza użycia w różnych kontekstach zdania należącego do spornej grupy dostarcza argumentów na rzecz minimalizmu semantycznego. Pokazuje ona, że zarówno samo słowo ‘wysoki’ posiada pewną treść wspólną dla wszystkich kontekstów i odniesień, jak też zdanie ‘Jan jest wysoki’ formułuje pewien sąd minimalny o określonych warunkach prawdziwości. For a long time the representatives of the social sciences had been passionately interested in whether certain identities in the moral aspect of different cultures, which are so numerous and different, can be found.

Historians have often described embryology and concepts of development in the period around 1800 in terms of “temporalization” or “dynamization”. This paper, in contrast, argues that a central epistemological category in the period was “rhythm”, which played a major role in the establishment of the emerging discipline of biology. I show that Caspar Friedrich Wolff’s epigenetic theory of development was based on a rhythmical notion, namely the hypothesis that organic development occurs as a series of ordered rhythmical repetitions and variations. Presenting Christian Heinrich Pander’s and Karl Ernst von Baer’s theory of germ layers, I argue that Pander and Baer regarded folding as an organizing principle of ontogenesis, and that the principle’s explanatory power stems from their understanding of folding as a rhythmical figuration. In a brief discussion of the notion of rhythm in contemporary music theory, I identify an underlying physiological epistemology in the new musical concept of rhythm around 1800. The paper closes with a more general discussion of the relationship between the rhythmic episteme, conceptions of life, and aesthetic theory at the end of the eighteenth century. (shrink)

The notion of ‘Inclusionary Othering,’ in garnering uptake within diverse nursing spheres, muddies a critical understanding of Othering by obscuring the colonial production, exploitation and perpetuation of the Other for economic and political gain. The ongoing genocide of Indigenous women and girls in Canada is a direct manifestation of the Othering process and in response to the report's Calls for Justice, it is an apt time to re‐enliven the conversation of the process of Othering's philosophical construction. The purpose of this (...) article is to re/turn to the philosophical underpinnings of the process of Othering in hopes of enlivening a new wave of resistance within nursing and elsewhere to the means by which the Other is constructed as well as to the notion of Inclusionary Othering itself. Perhaps this re/turn to the philosophy of Edward Said and Sylvia Wynter can result in further thwarting the Othering construct by highlighting its colonial construction and usher in a pragmatic shift, increasing critical engagement with the construct as well as inspiring a re/newed resistance toward Othering in nursing practice. With the recent advent of systems biology, developmental biology is taking a new turn. Attempts to create a ‘digital embryo’ are prominent among systems approaches. At the heart of these systems-based endeavours, variously described as ‘in vivoimaging’, ‘live imaging’ or ‘in totorepresentation’, are visualization techniques that allow researchers to image whole, live embryos at cellular resolution over time. Ultimately, the aim of the visualizations is to build a computer model of embryogenesis. This article examines the role of such visualization techniques (...) in the building of a computational model, focusing, in particular, on the cinematographic character of these representations. It asks how the animated representation of development may change the biological understanding of embryogenesis. By situating the animations of the digital embryo within the iconography of developmental biology, it brings to light the inextricably entwined, yet shifting, borders between the animated, the living and the computational. Over the course of the last three decades, computer simulations have become a major tool of doing science and engaging with the world, not least in an effort to predict and intervene in a future to come. Born in the context of the Second World War and the discipline of physics, simulations have long spread into most diverse fields of enquiry and technological application. This paper introduces a topical collection focussing on simulations in the life sciences. Echoing the current state (...) of tinkering, fast developments, segmentation of knowledge and interdisciplinary collaboration, and in an effort to bridge the science-humanities divide, the contributors to this collection come from multiple disciplinary backgrounds, including information studies, cognitive sciences, philosophy and biology. The ambiguous character of simulations, their cutting across scientific disciplines, analysis and prediction, understanding and doing, gave rise to their success in contemporary life sciences and has been the object of much scientific debate. One of the main aims of this topical collection, by contrast, is to call into question the assumption of an obvious use and easy transfer of methods between fields of knowledge as diverse as, e.g. physics and biology. The collection presents historical case studies from various biological sub-fields. The articles study how simulations are used and the ways they contribute specifically to our understanding of life. Taking up Sergio Sismondo’s description of simulations as “compromises” and “glue”, they also critically engage with the question of what exactly the life sciences have been gluing together over the last two decades.
